AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and the American Homebrewers Association (“Company”, “we”, “us”, or “our”), a division of the Brewers Association, concerning your access and use of the American Homebrewers Association Forum (“AHA Forum” or “Forum”).

You agree that by accessing the AHA Forum, you have read, understood and agree to be bound by these Terms of Use, including the Privacy Policy on the BrewersAssociation.org/privacy-policy.

Supplemental terms and conditions or documents that may be posted on the AHA Forum or on our website, HomebrewersAssociation.org, from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. From time to time, we may modify or change this policy, so please check back from time to review any changes or updates we may make.

USER REPRESENTATIONS

By using the AHA Forum, you represent and warrant that: (1) you are of legal drinking age; (2) all registration information you submit will be true, accurate, current, and complete; (3) you will maintain the accuracy of such information and promptly update such information as necessary; (4) you have the legal capacity and you agree to comply with these Terms of Use; (5) you will not access the Forum through automated or non-human means, whether through a bot, script, or otherwise; (6) you will not use the Forum for any illegal or unauthorized purpose; and (7) your use of the Forum will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the AHA Forum (or any portion thereof).

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

MEMBERSHIP REQUIREMENTS AND ACCESS

An active American Homebrewers Association membership is not required to access the AHA Forum. The AHA Forum is open to all parties that meet and agree to our terms of use. Although membership is not required to use the Forum, we reserve the right to change our Forum requirements, limit specified areas of the Forum for members-only use and adjust pricing for membership at any time as we may determine in our sole and absolute discretion. Any Forum requirements, membership price changes, or material changes to membership will take effect following notice to our members and Forum users.

MODERATORS

All users must follow instructions from Forum moderators. Forum moderators reserve the right to move, delete or edit posts at the moderator’s discretion without notifying the posters. Removing posts is a manual process. Forum moderators may not be able to remove or edit messages immediately. This policy applies to member profile information as well.

AHA FORUM POLICES AND RULES

You agree, through your use of the AHA Forum, that you will not post any material which is false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person’s privacy, or otherwise in violation of any applicable law. You also agree not to post any copyrighted material unless you own the copyright, or you have written consent from the owner of the copyrighted material. Spam, flooding, unauthorized advertisements, chain letters, pyramid schemes, and solicitations are also forbidden on this Forum.

Note that it is impossible for the staff or the owners of this Forum to confirm the validity of every post. Please remember that we do not actively monitor all posted messages, and as such, are not responsible for the content contained within. We do not warrant the accuracy, completeness, or usefulness of any information presented. The posted messages express the views of the author, and not necessarily the views of this Forum, its staff, its subsidiaries, or this Forum’s owner. Anyone who feels that a posted message is objectionable is encouraged to notify an administrator or moderator of this Forum immediately.

You remain solely responsible for the content of your posted messages. Furthermore, you agree to indemnify and hold harmless the owners of this Forum, any related websites to this Forum, its staff, and its affiliates. The owners of this Forum also reserve the right to reveal your identity (or any other related information collected on this service) in the event of a complaint or legal action arising from any situation caused by your use of this Forum.

You agree not to wrongly imply that content you submit to the Forum is sponsored or approved by the AHA.

These terms do not obligate the AHA to store, maintain, or provide copies of content you submit, and to change it, according to these terms.

Content you submit to the Forum belongs to you, and you decide what permission to give others for it. But at a minimum, you license the AHA to provide content that you submit to the Forum to other current and future users of the Forum and to our staff. That license allows the AHA to copy, publish, and analyze content you submit to the Forum. When content you submit is removed from the Forum, whether by you or by us, the AHA’s license ends when the last copy disappears from our systems.

You have the ability as a new user to choose your username as your register. You must keep the name appropriate. With this user account you are about to register, you agree to never give your password out to another person except an administrator, for your protection and for validity reasons. You also agree to never use another person’s account for any reason. We also highly recommend you use a complex and unique password for your account, to prevent account theft.

After you register and login to this Forum, you will be able to fill out a detailed profile. It is your responsibility to present accurate information. Any information the Forum owner or staff determines to be inaccurate or vulgar in nature will be removed, with or without prior notice. Appropriate sanctions may apply, including but not limited to exclusion from the Forum.

By using the AHA Forum and without limiting any other remedies, your breach of any of the representations above may constitute a violation of the AHA Non-Discrimination Policy, found at HomebrewersAssociation.org/non-discrimination-policy. You also agree to be bound by the Brewers Association Marketing and Advertising Code, which are incorporated into these Terms of Use and found on BrewersAssociation.org/brewers-association-advertising-marketing-code.

CANCELLATION

You may cancel your Forum account at any time by contacting info@brewersassociation.org.

LIMITATIONS OF LIABILITY

Information on the Forum is for informational purposes only, and shall not be viewed as legal, accounting, or other professional advice, nor as substitutes for such advice. You shall use information found on the Forum at your own risk and you recognize and agree that we shall incur no liability of any kind arising from or relating to your use of or reliance on information provided on the Forum.

PRIVACY

We care about data privacy and security. By using the AHA Forum, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use. Further, we do not knowingly accept, request, or solicit information from anyone under the age of 21 or knowingly market to anyone under the age of 21.
